Terms

Last updated 28 October 2026

These terms are the agreement between you and us when you use thallo.garden. Please read them with the privacy notice, which says how we handle your data.

Who we are

thallo.garden is run by Brian, an individual in the United Kingdom (“we”, “us”). You can reach us at support@thallo.garden.

What thallo.garden is

thallo.garden looks at photos of your garden, keeps a record of what is growing there, and gives suggestions about looking after it. It is free, and anyone aged 18 or over can make an account, though we may limit how many new accounts are made in a day, or pause new accounts for a while. It is for your own garden and your own personal use, not for business use.

We are still building it, so features will change, and some may go. We may set limits, such as how many photos and messages a day or how many gardens an account can have, and change them. If we decide to stop running thallo.garden, we will tell you by email at least 30 days before, so you can take a copy of your data.

Your account

  • You must be 18 or over.
  • An account is for one person. Use an email address that is yours, and keep access to it safe: whoever can read it can sign in.
  • If you think someone else has signed in to your account, tell us at support@thallo.garden and we will sign it out everywhere.

Your photos and messages

Your photos and messages stay yours. You give us permission to store them, to process them, and to send them to the companies named in the privacy notice, only so that we can provide thallo.garden to you. That permission ends when you delete them, apart from the short times the privacy notice gives for backups and logs.

When you upload a photo or send a message, you confirm that:

  • you took the photo, or have the right to use it;
  • it shows a garden or plants you look after, and you have the owner’s permission if the garden is not yours;
  • you have avoided showing other people where you can, and have their permission where you can’t.

Using it fairly

Please don’t:

  • upload anything unlawful, or anything that isn’t about a garden;
  • use thallo.garden to harass anyone, or to watch or record other people or their property without their knowledge;
  • try to get round its limits, reach other people’s data, or overload or break it;
  • use automated tools to access it, or copy it to make a competing service.

If you do, we may suspend or close your account. Unless there is a serious risk to others or to the service, we will email you first and give you the chance to put it right.

Your gardener’s advice

Your gardener is an AI model. It works only from your photos, what you tell it and the weather, and it can be wrong: it may mistake one plant for another, miss a problem, or misjudge the light or the weather. Its suggestions are for you to weigh up, and you decide what to do in your garden.

  • Never eat or use a plant, berry or fungus because of what your gardener says about it.
  • Check a product’s label before using any feed, weedkiller or pesticide, and follow the label.
  • For work at height, large trees, electrics, walls or anything else that could hurt someone, ask a qualified professional, such as an arborist.
  • If you think a person or an animal has eaten something harmful, contact NHS 111, emergency services or a vet straight away.

Weather comes from Apple Weather and sun times are worked out from the place you give, so both are estimates.

Keeping it running

We do our best to keep thallo.garden working and your data safe, but as a free pilot it may sometimes be unavailable, slow or wrong. Keep your own copies of photos that matter to you.

Our responsibility to you

If we break these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss or damage is foreseeable if it was obvious it would happen, or if you and we both knew it might happen when you started using thallo.garden. We are not responsible for loss or damage that is not foreseeable.

Because thallo.garden is for personal use, we are not responsible for any loss of business, profit or opportunity. If something we provide damages your device or other digital content because we did not use reasonable care and skill, we will repair the damage or pay you fair compensation.

Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit, and nothing affects your legal rights as a consumer.

Ending

You can stop using thallo.garden at any time, and delete your account from Account. We may close an account as set out above, or when the pilot ends, with notice by email. When an account is closed, its data is deleted as the privacy notice describes.

Changes to these terms

We may change these terms as thallo.garden develops. If a change matters to you, we will email you at least 14 days before it takes effect. If you don’t agree, you can delete your account before then.

The law that applies

These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales; if you live in Scotland or Northern Ireland, you can also bring it in the courts where you live.

If you have a problem, please tell us first at support@thallo.garden. We will try to put it right.
